FOR CAPTIVATE ACTION WORKSHOPS, COURSES AND EVENTS
For the purposes of these Terms and Conditions, ‘Captivate Action’ refers to Captivate Action Pty. Ltd. (Australia) and Captivate Action Ltd. (United Kingdom and Europe).
Registration for, payment for, or participation in any Captivate Action event constitutes acceptance of these Terms and Conditions. Captivate Action reserves the right to refuse enrolment or remove a participant from a course, workshop or event if they breach these Terms and Conditions

Inclusivity, Respect and Safety
- Captivate Action is committed to providing inclusive, welcoming and supportive learning environments where all participants feel safe, respected and valued at all times. We have a strict policy of treating all participants equally, regardless of gender identity, sex assigned at birth, sexual orientation, age, marital status, nationality, race, religion, ethnicity, abilities, disabilities, or any other protected characteristic.
- All participants are expected to contribute to a safe and respectful environment and must respect the physical, emotional, psychological and sexual safety of all individuals attending a Captivate Action event. Any participant who engages in discriminatory, intolerant, threatening, inappropriate or harassing behaviour towards others may be asked to leave an individual session or the entire workshop, course or training event at the discretion of the Tutor and/or Captivate Action. Participants removed under these circumstances will not be entitled to a refund.
- Captivate Action encourages all participants to report any behaviour that makes them feel unsafe, uncomfortable or threatened. Concerns may be raised with a Tutor, classroom assistant or the Company Director during or after the event. All individuals attending a Captivate Action event are also required to comply with Captivate Action’s Occupational Health and Safety (OHS) Policy at all times.

Payments and Confirmation of Registration
- A participant’s place on a Captivate Action course is only confirmed once all required payments have been received. A minimum 50% deposit is required to secure a place on a course, and all outstanding fees must be paid in full prior to the commencement of the event. If full payment has not been received by the course commencement date, Captivate Action reserves the right to offer the participant’s place to another individual. Any fees paid will be subject to Captivate Action’s Cancellations, Refund and Deferment policy.

Cancellations, Refunds and Deferments
- Captivate Action does not provide refunds for participant cancellations, change of mind, scheduling conflicts, illness, travel disruptions or other personal circumstances. Once a participant has registered for an event and any amount of the course fee has been paid, those fees are retained by Captivate Action to cover costs already incurred or committed as a result of that registration. These costs may include venue hire, equipment, administration, payment processing fees, travel expenses and staffing costs.
- In some circumstances, participants may apply to defer their enrolment to a future equivalent course of equal value. Deferments are offered at the sole discretion of Captivate Action and are not guaranteed. To be considered for a deferment, a Deferment Application must be submitted and received by Captivate Action prior to the commencement date of the original course. Any approved deferred enrolment must be redeemed within 12 months of the original course date, unless otherwise agreed by Captivate Action. After this period, any fees paid will be forfeited. Captivate Action cannot guarantee that an equivalent course will be offered within this timeframe, and deferments may not be available for courses that are in high demand, have limited capacity, or are subject to participant density restrictions.
- If a participant is unable to attend an event for any reason, they are asked to notify Captivate Action as soon as possible so that their place may be offered to another participant. Nothing in these Terms and Conditions excludes, restricts or modifies any rights or remedies available under Australian Consumer Law.

Illness and Infectious Diseases
- Participants must not attend a Captivate Action event if they are experiencing symptoms of a contagious or infectious illness, have been advised to isolate, or are subject to any government or public health restrictions that prevent them from attending. Participants are encouraged to notify Captivate Action as soon as possible if they are unable to attend due to illness so that appropriate arrangements can be considered.
- For ongoing courses, Captivate Action will endeavour to support participants who miss classes due to genuine illness by offering opportunities to catch up on missed content, where reasonably possible. However, this cannot be guaranteed and will vary depending on the nature of the course.
- Participants should be aware that some courses, including certification programs, have minimum attendance requirements and successful completion may not be possible where repeated absences occur. While Captivate Action encourages participants to prioritise the safety and wellbeing of others by remaining at home when genuinely unwell, participants are also expected to attend all scheduled sessions whenever they are fit and able to do so.
- Any requests to transfer or defer enrolment due to illness will be considered in accordance with Captivate Action’s Cancellations, Refunds and Deferments policy.

Changes to Courses or Events
- Captivate Action reserves the right to alter course dates, times, venues and content, add or remove classes, or cancel a course, workshop or event due to operational, safety or unforeseen circumstances.
- If Captivate Action cancels an event, or if a change to the date or time of an event prevents a participant from attending, participants will be offered the option of either a full refund or a deferment to a subsequent equivalent course, where available.

Qualified Instructors
- All dramatic combat courses are taught by professional instructors who hold recognised teaching qualifications in dramatic combat. Instructors are certified by professional organisations such as the Society of Australian Fight Directors Inc. (SAFDi), the British Academy of Dramatic Combat (BADC), the Academy of Performance Combat (APC), or an equivalent recognised professional body.

Scope of Training and Professional Practice
- Captivate Action courses are designed for performance training only and are not intended to provide sufficient training to independently choreograph, supervise, teach or direct dramatic combat.
- Participation in any Captivate Action course, workshop or certification program does not certify, accredit or qualify a participant to work as a Fight Director, Fight Choreographer, Dramatic Combat Instructor, Movement Director, Performance Capture Director, Motion Capture Director, or in any related teaching, directing or supervisory role. These professions carry significant creative, ethical and occupational health and safety responsibilities and require extensive training, practical experience, mentorship and professional accountability.
- Participants wishing to pursue a professional career in fight direction or dramatic combat instruction should undertake further training through a recognised professional body, such as the Society of Australian Fight Directors Inc. (SAFDi), the British Academy of Dramatic Combat (BADC), the Academy of Performance Combat (APC), or another recognised industry organisation. Participation in Captivate Action courses does not guarantee eligibility for, or admission into, these pathways.

Intellectual Property and Use of Course Material
- All choreography, exercises, workshop content and other original material taught as part of a Captivate Action course are provided for educational and performance training purposes only and remain the intellectual property of Captivate Action and/or the relevant Tutor, unless otherwise stated.
- Participants must not reproduce, adapt, teach, publish, communicate, perform or otherwise use this material in a production, film, workshop, demonstration, educational setting or online content without prior written permission from Captivate Action. Attribution alone does not constitute permission to use this material. Class content, including choreography, teaching exercises and training material, must not be recorded, shared or repurposed without the explicit permission of Captivate Action.
- Participants will often be given opportunities to photograph or record their own work for personal, promotional, archival or showreel purposes, provided approval has been granted by Captivate Action and the privacy and consent of other participants is respected.
- Captivate Action may photograph or film participants for promotional purposes only where appropriate Media Release consent has been obtained.

Physical Activity, Safety and Risk
- Dramatic Combat, Movement and Performance Capture/Motion Capture training are physically demanding activities and, despite the implementation of rigorous safety procedures, carry an inherent risk of injury.
- Captivate Action is committed to providing a safe learning environment and will take all reasonable steps to minimise risk through qualified instruction, established Occupational/Work Health and Safety procedures, appropriate supervision, and the ongoing reinforcement of safe training practices.
- Participants are encouraged to communicate openly with Tutors and are never expected to undertake activities that exceed their physical capabilities or personal boundaries. All instruction should be considered an invitation to participate, and participants are encouraged to alert a Tutor if they require an alternative exercise or need to sit out of an activity for any reason.
- Participants must inform Captivate Action of any injury, medical condition, medication or other circumstance that may affect their ability to participate safely or may place themselves or others at risk.
- Participants are expected to follow all safety instructions, exercise good judgement and conduct themselves in a safe and respectful manner at all times. Dangerous, negligent or reckless behaviour may result in removal from a class, workshop or event at the discretion of Captivate Action.
- While every reasonable precaution is taken to minimise risk, participants acknowledge that accidents can occur and that participation is undertaken at their own risk. To the extent permitted by law, Captivate Action will not be liable for injuries arising from the inherent risks associated with these activities, the actions of other participants, or a participant’s failure to follow safety instructions or disclose relevant information.
- Nothing in these Terms and Conditions excludes, restricts or modifies any rights or remedies available under Australian Consumer Law.

Challenging Content and Participant Wellbeing
- Captivate Action training is delivered in a fun, exploratory and supportive environment. However, due to the nature of dramatic combat and intimacy training, participants may at times encounter content, scenarios, exercises or training weaponry that they find challenging, confronting or triggering.
- Participants are encouraged to communicate openly with Tutors before, during or after a workshop if they feel any aspect of the training may be distressing, so that appropriate strategies and adjustments can be discussed and, where reasonably possible, implemented to support their participation.
